Terms of Service

Last updated: October 6, 2026

These Terms of Service (“Terms”) govern access to and use of InkCompanion at inkcompanion.com (the “Service”), operated by Crasome OÜ (“we,” “us,” “our”), registry code 12650861, registered address Harju maakond, Tallinn, Lasnamäe linnaosa, Pae tn 25-47, 11414.

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Note on this version: The Service is in an invite-based beta and is free of charge. The subscription and payment sections below apply only if paid plans are introduced. Statutory consumer rights, including any applicable withdrawal right, are not limited to paid plans. The beta-specific sections (Beta Access, Usage Limits and Monitoring) describe how the Service runs today.

1. Who We Are

The Service is operated by:

Crasome OÜ

  • Registry code: 12650861
  • Address: Harju maakond, Tallinn, Lasnamäe linnaosa, Pae tn 25-47, 11414
  • General: info@crasome.com
  • Support: support@inkcompanion.com
  • Privacy: privacy@inkcompanion.com
  • Illegal content/DSA notices: copyright@inkcompanion.com

2. The Service

2.1 InkCompanion provides a private digital reading environment and AI-assisted reading tools, including text processing, summaries, character insights, chapter notes, relationship mapping, discussion features, and related functionality.

2.2 The Service is a tool for processing content that you upload or otherwise provide. We do not supply books or other source works to users. You are responsible for the content you upload.

2.3 AI Disclosure: The Service uses artificial intelligence systems to generate summaries, insights, character maps, and chat responses. You are interacting with an AI system, not a human. AI-generated outputs may be inaccurate, incomplete, misleading, or unsuitable for your purposes. You should verify important information independently.

2.4 We may change, suspend, or discontinue features of the Service from time to time, subject to applicable law.

3. Beta Access

3.1 The Service is currently offered in an invite-based beta. You can create an account only with a valid, operator-issued invitation.

3.2 Invitations are personal and non-transferable. We may revoke an unused invitation. We may also end participation in the free beta under Section 18, subject to applicable law.

3.3 During the beta, the Service is provided “as is” and “as available.” We make no service-level or availability commitment of any kind for the beta.

3.4 During the beta, features, usage limits, and the Service itself may change, be restricted, or be discontinued, subject to Section 19 and applicable law.

3.5 The beta is free of charge. If paid plans are introduced, the subscription and payment sections of these Terms will apply to them. Withdrawal and other statutory consumer rights apply where required by law, whether or not the Service is free.

4. Accounts and Eligibility

4.1 You must be at least 16 years old to use the Service. If you are under 18, you represent that you have the consent of a parent or legal guardian.

4.2 You are responsible for maintaining the confidentiality of your account credentials and for activity occurring under your account.

4.3 You agree to provide accurate account information and keep it up to date.

5. User Content

5.1 “User Content” means books, files, text, documents, prompts, notes, chat messages, and other content you upload or submit through the Service. AI-generated results are called Outputs below.

5.2 You retain any rights you hold in your User Content, subject to the license below.

5.3 You grant us a limited, non-exclusive license to host, store, parse, process, and display your User Content only as needed to provide and secure the Service, respond to support or legal requests, and comply with applicable law. This includes generating AI insights at your request and sending relevant excerpts to AI providers as described in our Privacy Policy. You may withdraw this license for content you have the right to control by deleting that content or requesting account erasure, subject to lawful retention described in our Privacy Policy.

5.4 The Service is designed so that your uploaded books and generated insights are private to your account. However, you acknowledge that no system is completely error-free, and we do not warrant absolute confidentiality, security, or non-access except as required by law.

5.5 You represent and warrant that:

  • you have the right to upload and use the content you provide;
  • your content does not infringe third-party intellectual property rights;
  • your content is not unlawful, defamatory, or otherwise prohibited by these Terms;
  • where required, you have obtained all necessary licenses or permissions.

5.6 You are solely responsible for backing up content that is important to you. While we take commercially reasonable measures to protect data, we do not guarantee that content will never be lost, corrupted, or unavailable.

5.7 Deletion of User Content: You can delete books and reading sessions through the Service, and delete your account from Settings. If you cannot access your account, contact privacy@inkcompanion.com to request erasure. We will handle requests in accordance with applicable data protection law. Deleting a book or session removes its associated active records and files; copies in backups, logs, workflow traces, and third-party systems may have separate retention periods. See our Privacy Policy for further information.

6. Acceptable Use

You agree not to use the Service to:

6.1 use scripts, bots, crawlers, headless browsers, or similar means to scrape, bulk extract, or send excessive requests to the Service. This does not prohibit assistive technologies used for ordinary access or activity expressly permitted by mandatory law;

6.2 use Outputs or data obtained from the Service to train, fine-tune, or otherwise develop a machine-learning model (“distillation”). This does not restrict your use, outside the Service, of User Content that you independently own or have the right to use;

6.3 attempt to extract, probe, or reconstruct the Service’s internal instructions, system prompts, models, or architecture, or reverse engineer, decompile, or disassemble the Service. This does not restrict observation, study, or testing of software functionality or limited decompilation for interoperability where protected by mandatory law, including EU Directive 2009/24/EC;

6.4 circumvent usage limits or rate controls, or share your account, uploaded books, or generated outputs with other users in a way that circumvents the private, single-user nature of the Service;

6.5 upload, process, or distribute content that you do not have the right to use, or content that is unlawful, defamatory, or otherwise prohibited by these Terms;

6.6 infringe copyright, trademarks, patents, trade secrets, privacy rights, or other third-party rights;

6.7 unlawfully bypass, remove, or circumvent DRM or other technological protection measures, or upload content in a way that infringes third-party rights;

6.8 systematically collect Outputs or non-public information through the Service to develop, test, improve, or operate a competing AI-assisted reading product, or use such collected material for that purpose, including a public summary database, study-guide library, or relationship-mapping tool. This does not restrict independent development based on publicly available ideas, independent use of User Content you have the right to use, or activity protected by mandatory law;

6.9 resell, sublicense, or commercially exploit AI outputs generated from third-party copyrighted works without permission, except to the extent permitted by law;

6.10 upload malicious code, attempt to probe or disrupt the Service, or interfere with its operation;

6.11 use the Service to generate unlawful content, including content that infringes third-party rights or violates applicable law;

6.12 upload special category personal data about yourself or others unless strictly necessary and lawful.

7. Usage Limits and Monitoring

7.1 We may impose, change, or remove usage limits for the Service — such as quotas and rate limits — at our discretion. These limits are operational configuration and may differ between accounts, features, or periods; these Terms intentionally do not state their numeric values.

7.2 We monitor usage of the Service for security, integrity, and abuse-prevention purposes, including maintaining rate-limiting and abuse-detection counters, as described in the security section of our Privacy Policy.

8. AI Features and Outputs

8.1 The Service may generate summaries, notes, character maps, chapter insights, answers, and other outputs (“Outputs”) based on your User Content and prompts. Outputs are generated by artificial intelligence.

8.2 Outputs are provided for informational purposes. They may be inaccurate, incomplete, outdated, or misleading. Outputs should not be relied upon as professional, legal, medical, financial, or other expert advice.

8.3 We do not guarantee that Outputs will be unique. Other users may receive similar outputs from similar prompts, subject to the private nature of their own content and usage.

8.4 To the extent permitted by law, we assign to you any rights we may have in the Outputs generated for your account. This assignment does not transfer rights in the Service, including its software, design, branding, documentation, internal instructions, system prompts, models, and underlying systems, or any rights held by third parties. You remain responsible for your use of Outputs and for compliance with these Terms, applicable law, and third-party rights.

8.5 You agree not to use Outputs in a manner that infringes third-party rights, including by publishing or distributing substantial summaries or derivative content from copyrighted works without authorization.

8.6 If you publish or publicly distribute Outputs outside the Service, you are responsible for complying with applicable disclosure obligations, including those under Article 50(4) of the EU AI Act where relevant.

8.7 How the Service discloses its AI nature is described in our Privacy Policy (Section 13, AI Feature Disclosure).

9. AI Training and Third-Party Providers

9.1 We do not use the full text of your uploaded books or your private AI chat messages to train our own AI models.

9.2 We may use aggregated, de-identified technical and usage statistics that do not reveal the content of your books or chat messages, such as feature usage, error rates, performance metrics, and general product analytics.

9.3 The Service sends relevant content and prompts to third-party AI providers through a model-routing proxy. Provider terms, training restrictions, and retention practices depend on the provider in use and must not be assumed to be identical across providers. See our Privacy Policy for details.

10. Subscriptions, Payments, and Taxes

10.1 If the Service is offered on a paid subscription basis, fees will be displayed before purchase.

10.2 If paid plans are introduced, we will disclose the payment processor and its applicable terms before checkout.

10.3 Any applicable taxes and the total price will be shown before you place a paid order.

10.4 We may change pricing with reasonable notice. Price changes will apply from the next renewal period.

10.5 Subscriptions may renew automatically until canceled, unless otherwise stated at checkout. You may cancel before the next billing date. Cancellation stops future billing but does not automatically create a refund for the current billing period, except where required by law.

10.6 Refunds will be handled in accordance with applicable consumer protection law and the terms disclosed at checkout.

11. Right of Withdrawal for EU/EEA Consumers

11.1 If you are a consumer in the EU/EEA, you generally have a 14-day right of withdrawal from distance contracts.

11.2 Exceptions to the withdrawal right depend on the type of contract and applicable law. Immediate access alone does not automatically remove this right.

11.3 If paid plans are introduced, any request for immediate performance and any applicable acknowledgment about withdrawal will be presented separately at checkout, where required by law.

11.4 There is currently no paid plan or in-app withdrawal function. If a statutory withdrawal right applies to your use of the Service, you may exercise it by contacting support@inkcompanion.com or by any other method allowed by applicable law. This applies whether the Service is free or paid.

11.5 This does not affect your statutory rights regarding defective services or non-conformity under EU consumer law.

12. Intellectual Property

12.1 We own or license rights in the Service, including software, design, branding, documentation, internal instructions, system prompts, models, and underlying systems. This does not affect your rights in User Content under Section 5 or any rights assigned to you in Outputs under Section 8.4.

12.2 Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service while your account is active. No other rights in the Service are granted to you.

12.3 During the beta, you may access and use the Service only for personal, non-commercial purposes unless we provide separate written permission for commercial use. This restriction governs use of the Service, not your use of Outputs, which remains subject to Sections 6 and 8, applicable law, and third-party rights.

12.4 If you provide feedback or suggestions, you grant us a non-exclusive, royalty-free license to use them without restriction or obligation to you.

13. Illegal Content Notices and Content Moderation

13.1 We respect the intellectual property rights of others.

13.2 If you believe that specific content stored through the Service is illegal, including copyright infringement, send a notice to copyright@inkcompanion.com with enough detail to identify the content, why you believe it is illegal, and your contact details where applicable. For a copyright complaint, identify the protected work and your authority to act for its rights holder.

13.3 We will review notices, may request more information, and take action required by applicable law. This may include disabling access to illegal content or restricting an account.

13.4 Where applicable law requires us to give a statement of reasons for a content restriction, we will provide one and explain the available avenues of redress.

13.5 We may suspend or terminate accounts of repeat infringers where appropriate.

14. AI Feature Transparency

14.1 The Service uses AI to produce reading insights and chat responses. Disclosure requirements depend on the feature and applicable law.

14.2 The discussion interface identifies the reading assistant as AI.

14.3 The Service is intended as a reading aid, not to make decisions about access to essential services or other matters affecting legal rights.

15. Disclaimer of Warranties

15.1 The Service is provided “as is” and “as available”.

15.2 To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and uninterrupted service.

15.3 We do not warrant that:

  • the Service will be error-free, secure, or always available;
  • AI Outputs will be accurate, complete, or suitable for any particular purpose;
  • content will never be lost;
  • third-party providers will act in any particular manner.

15.4 Nothing in these Terms excludes or limits rights that cannot be excluded or limited under applicable law.

16. Limitation of Liability

16.1 Nothing in these Terms limits or excludes liability for intent, gross negligence, fraud, death, personal injury, or any other liability that cannot be limited or excluded under applicable EU or Estonian law.

16.2 Subject to 16.1, to the maximum extent permitted by law, our total aggregate liability arising out of or related to the Service or these Terms shall not exceed the greater of:

  • the amounts paid by you to us for the Service in the 12 months preceding the claim; or
  • €100.

16.3 Subject to 16.1, we are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or goodwill, even if we were aware such damages might occur.

16.4 These limitations apply to the fullest extent permitted by law, including for consumers where mandatory law does not provide otherwise.

17. Indemnification

17.1 To the extent permitted by law, you agree to indemnify us for reasonable losses resulting from third-party claims to the extent caused by your unlawful User Content, material breach of these Terms, or infringement of third-party rights, including unlawful distribution of Outputs. This does not cover losses caused by our own conduct.

17.2 We reserve the right to participate in the defense of any claim with counsel of our choosing.

18. Suspension and Termination

18.1 We may suspend or terminate your access to the Service if:

  • we close the free beta or reduce participation because the beta has reached capacity;
  • you breach these Terms (including the Acceptable Use rules in Section 6);
  • we are required to do so by law;
  • your use creates legal, security, or technical risk to the Service or others;
  • payment fails, where applicable.

18.2 We will give reasonable advance notice for routine beta closure, capacity-related removal, or other non-urgent suspension or termination. We may act immediately for serious breaches, legal requirements, or urgent legal, security, or technical risks, and notify you afterwards when appropriate and lawful.

18.3 Upon termination, your right to use the Service ends. Sections that by nature should survive termination will survive.

19. Changes to the Service or These Terms

19.1 We may update these Terms from time to time. If changes materially affect your rights or a paid subscription, we will provide reasonable notice, such as by email or in-app notice. We may change the Service to correct defects, address security risks, comply with legal requirements, maintain compatibility with third-party systems, manage capacity, or improve functionality. Where consumer law requires a valid reason to change an ongoing digital service, these are the reasons for doing so. We will provide any advance notice and termination rights required by that law.

19.2 If an updated version requires your agreement, we will ask you to affirmatively accept it before you continue using the Service. For other changes, continued use after their effective date constitutes acceptance to the extent permitted by law. If you do not accept an update, you should stop using the Service and, for paid subscriptions, cancel in accordance with these Terms.

20. Privacy

Our Privacy Policy explains what we collect, how AI requests are routed, retention and deletion, and your rights under the GDPR. It is a data-processing notice, not a contract.

21. Governing Law and Disputes

21.1 These Terms are governed by the laws of the Republic of Estonia, including the Law of Obligations Act (Võlaõigusseadus), without prejudice to mandatory consumer protection laws of the country where you habitually reside if you are an EU/EEA consumer.

21.2 If you are a consumer, you may bring proceedings before the courts of your country of residence where mandatory law allows. Otherwise, disputes will be subject to the courts of Harju County, Estonia.

21.3 The European Commission's Online Dispute Resolution platform closed in July 2025. For consumer dispute resolution information, see Consumer Redress in the EU. Any obligation to participate in alternative dispute resolution depends on applicable law.

22. Miscellaneous

22.1 If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.

22.2 Failure to enforce a provision does not waive our right to enforce it later.

22.3 These Terms constitute the agreement governing your use of the Service. The Privacy Policy describes our processing of personal data; it is not itself a contract.

22.4 We may assign these Terms in connection with a merger, acquisition, or sale of assets, subject to applicable law. You may not assign these Terms without our consent.
